The Collapse of the 28-Clause Peace Proposal for Ukraine: Why Peace Negotiations Continue to Falter

Europe experienced widespread relief on Monday, as the diplomatic emergency sparked by the announcement of a new 28-article proposal for ending the war appeared – momentarily – to have been stabilised. A American diplomat spoke of "notable headway" after diplomatic discussions in Geneva. On Monday night, Moscow made its countermove: another massive barrage of aerial bombardment on Kyiv.

The Cycle of Negotiation and Warfare

The sequence of conflicting incidents captured the bleak nature of the recent timeframe. By day, negotiation efforts are waged: hopeful statements are released from multiple capitals. Significant resources is devoted on restraining particular approaches. By night, the Kremlin brutally reminds the world that, for them, war remains the primary tool for achieving "peace".

After-Dark Attacks

As Russia's attack unfolded into the early hours of Tuesday, the current condition of Ukraine's defenselessness was revealed. Ukraine is able to track rocket firings from enemy soil, a capacity enabled by current data. From witness perspectives, Ukrainian air force fighter jets that had been scrambled to counter approaching cruise missiles roared overhead – advanced fighter aircraft provided to Ukraine by European allies.

Soon thereafter, Kyiv's missile defense activated: several firings fired to intercept a hostile projectile. This was a sophisticated defense system at work, most likely supplied through partner states. Every firing creates sudden vibrations, causing tremors. The instant of fear quickly gives way to sober acceptance: perhaps the incoming missile won't cause damage this time, protecting urban areas from devastation and another blackout.

Ongoing Risks

Following this, a heavy machine gun fired at a unmanned aircraft close by, part of a mobile-fire group – probably imported technology. Unfortunately, the projectiles didn't strike the enemy aircraft – it pressed on overhead toward its destination.

With pauses, this persisted until dawn. Kyiv awoke to the daybreak reports: seven people killed, devastation and infrastructure problems in multiple buildings as a result of the evening attack. As customarily, everyone still went about their day – living the war. But those entire period illustrated Ukraine's vital need on external assistance – a reliance that European nations are evidently unprepared to replace in the short term.

Unsuccessful Negotiations

The detailed framework from US administration provoked deep reactions, discussion and deep concern – and briefly redirected concern from Ukraine's major integrity crisis in years. Yet, we have witnessed similar scenarios, after prior negotiation attempts and international summits.

Every new approach from Washington unfolds according to the identical sequence: a negotiation push against Ukraine, which Kyiv, with other European capitals, succeeds in resisting. They stabilise the situation but never actually secure success. This pattern will, undoubtedly, persist.

Strategic Calculations

It is convenient to criticize particular leaders of consistently pushing Moscow's conditions. But that does not seem to be the complete picture. Washington functions according to a premise familiar among experienced diplomats: you cannot win at the negotiating table what you have been unable to protect through force. The White House presumes that it is impossible to force Russia to abandon the territory that it presently holds in Ukraine's occupied territories.

The issue is that while acknowledging this situation, US leadership does nothing to prevent Kremlin actions, through diplomacy or military means, from believing that the situation will not shift further in its advantage in the near future.

Conflicting Perspectives

Therefore, the Kremlin is certain that the clock favors them – that Ukraine and its partners are coming close to fatigue. Their motivation to agree to terms that does not give them the greatest potential benefit is almost completely absent. There may be many attempts to end hostilities, but they will carry on as long as Russia's government remains supremely confident in the result.

On the contrary, Ukrainian leadership believes that Ukraine can still persist, progressively conceding lives and land but preventing a entire defensive failure until circumstances change in its advantage.

Current Realities

Objectively, there are no real preconditions for a ceasefire. Now, personal considerations are entering the equation: political desires to negotiate peace and obtain worldwide acknowledgment, and Ukrainian leadership's twin challenges – on one hand, not to estrange crucial supporters, and on the other, to unite the population around the national cause against any initiative Kyiv finds unsuitable, so that their focus does not shift toward internal issues. And although their objective will now be much harder after latest incidents, it remains highly unlikely that this will alter their fundamental strategy.

These two forces are guiding negotiations.

Assessment and Future

It took a only one week to terminate the proposed articles of the latest plan. Assertive and inconsistent approach of the matter by American leadership, opposition by Ukraine and the rest of Europe, along with calming attempts of representatives, and finally, current information leaks, all served their function.

While new proposals based on old ideas are approaching, Kyiv, London and other European capitals should arrive at a critical understanding: Ukraine and Europe will only be able to counter diplomatic offensives from Washington that are founded on Moscow's terms and show certain reluctance to alter the situation, if they remain united and improve their protective measures at a considerably quicker tempo. If they do, no combination of diplomatic or military actions will be able to break them. In the meantime, Ukraine's capability to counter nocturnal attacks will, for the predictable period, mainly require sustained allied backing.
